Terms and Conditions Best Universe Technology Limited Room 2601, Mongkok Harbour Centre, 638 Shanghai Street, Kowloon, Hong Kong Definition "The Company" - Best Universe Technology Limited "Clients" - company/companies or individual who subscribe(s) Services "Agreement" - any agreement between the Company and Clients which expressly or impliedly incorporates these Terms and Conditions as the context demands. "Fees" - all fees or applicable tax as agreed between the Company and Clients. "Services" - all services provided by the Company to Clients. Services & Fees In consideration for payment of Fees, The Company agrees to provide Services to Clients. Clients shall pay Fees relating to its use of the Services. The Company will suspend or terminate Services without prior notice to Clients who fail to payment Fess. Prohibited Services The Company has the sole discretion to PROHIBIT activities or contents published through Services provided by Clients. These activities and contents include but not limit to followings. Illegal Material/Activities - any material/activies in violation of any law and regulation, under the jurisdiction of Hong Kong SAR Government and where Clients domiciled. Adult Material - all pornography, erotic images, or otherwise lewd or obscene content. Hacking Tool - pirated software, emulators, hacking, password cracking. Spamming - sending promotional emails with links on our server / sender's domain hosted in our server to recipients not agreeing to receive this kind of emails, no matter the e-mail is sent from our SMTP server or not. The definition of Spamming will follow the normal US & SpamCop practice. High Traffic Service - Chat Room, Forum, Message Board & Download Sites. Domain Ownership Clients have the ownership of the domains registered, on condition that Clients pay the relevant registration fees. Tools to Access Services Clients are responsible for and must provide all equipment necessary to access the Services and must comply at all times with The Company's requirements as regards mode of access and/or use of the Services. Traffic/Bandwidth and Storage Quota All Services have a set allotment of traffic/bandwidth and storage quota available for use, where applicable. Any excessive monthly usage will be charged accordingly. Unused traffic/bandwidth cannot be carried over to the following month. Data Backup Clients should always backup all the data contents, including but not limited to their website files and email, by themselves. The Company will not take any responsibility for any data content loss. Risk Disclosure of Service The Clients expressly agree and accept the use of Services is at the Clients' sole risk and that the entire risk as to the quality and performance of Services. The Company or any or its directors, employees or agents DO NOT warrant that Services will be uninterrupted or error free. The Company or its directors, employees or agents will NOT be responsible for and NOT liable to Clients for any damage, (including, but without limitation, special, incidental, or consequential damage) arising from the use of, or inability to use (for whatever reason), Services. Breach of Terms and Conditions In case of Clients breaching the Terms and Conditions, the Company reserves the right to suspend or terminate Services to Clients, without prior notice, at its sole discretion. Termination of Services & Refund Policy Upon termination of Services by either party, The Company shall refund any Fees, where applicable, according to Agreement. Liability Indemnity Clients shall be entirely responsible for all use of the Services and agrees to indemnify the Company against all and any liability arising, directly or indirectly, and in any jurisdiction, out of the use of Services. Collection of Personal Data All personal data collected will be used solely for verification purpose and will be kept confidential. The Company will validate data provided using generally accepted practices and guidelines. The Company fully complies with the "Rights of Access and Correction" obligations of the PDPO. Individual Provision Validity If any provision of this Agreement is found to be invalid the other provisions shall remain in full force and effect. All obligations and restrictions on Clients under this Agreement will survive the termination of this Agreement and/or the termination of the provision of any of Services. No waiver by either party of a breach of any provision of this Agreement, non delay or omission to exercise any right shall constitute a waiver of any other breach or default by the other party. Change of T & C The Company reserves the rights to change the Terms and Conditions without prior notice.
